BELLEVUE, WA –-(Ammoland.com)- PATRIOTS: Another month into 2014 means more victories for the Second Amendment Foundation.

SAF’s latest victory came in New Mexico when the chief U.S. District Court judge granted a permanent injunction against the State of New Mexico’s “citizens only” concealed carry law.

This discrimination ruling makes it increasingly difficult for gun control advocates to chip away at gun rights. It helps build case law. If legal aliens have rights, citizens obviously do, too. The more people that have rights in the U.S, the harder it will be for the anti-gunners to take those rights away.

We have shown no signs of slowing down and will continue to make a difference throughout 2014. We will continue to protect our 2nd Amendment rights but cannot do so without the help of the patriots that keep our doors open every day.

This law unfairly discriminated against permanent legal resident aliens in a case brought by the Second Amendment Foundation. Chief Judge Armijo issued an order that says the New Mexico statute “violates the Equal Protection Clause” of the Constitution’s 14th Amendment.

This is a victory not only for our plaintiff, John W. Jackson, but for all permanent legal resident aliens who are otherwise qualified to obtain a concealed handgun license.

Jackson is an Australian citizen, but resides in Rio Rancho, N.M. One of the more significant notations in the ruling is that the court found New Mexico’s statute discriminates on the basis of alienage, and as a result, was subject to strict scrutiny.

The ruling does not declare the state’s concealed carry law unconstitutional, but it does conclude that the remedy for violating the equal protection clause is to sever the citizenship provision from the statute. This can be done, the judge said, “without impairing the remainder” of the state’s concealed carry law, which still requires an applicant to meet all of the state’s remaining requirements.

This is one more example of how SAF is winning firearms rights one lawsuit at a time. Mr. Jackson has demonstrated that he is a productive member of the community and certainly did not give up any right to personal protection by moving from his country to our country.

Although we are celebrating the victory of one lawsuit, 19 open cases remain for the Second Amendment Foundation to defend around the country. It lies in the courts where SAF makes the biggest difference. We will defend our gun rights from anti-gun laws from coast to coast.

Gun grabbers think that past gun control efforts have worn us down and hope you and I will quit the fight to protect individual rights.

Alan and the 2nd Amendement Foundation have done some great work and deserve our support. Sad that after Otis McDonald went to the Supreme Court, NRA let the worst contract lobbyist in America write the HB183 carry bill with Rep. Brandon Phelps.
Duty to Inform w/ criminal penalties, because DTI worked out so well in Ohio, criminal penalties of 6 months or 1 year in jail for gun free zones, and an UNLIMITED state & federal privacy waiver.
Gun owners in IL waited FIFTY years for their rights, and Todd Vandermyde betrayed them all in one session. Great work NRA!
