NJ Assemblymen Introduces ‘Shaneen’s Law’ Allowing Judges Sentencing Discretion

Manasquan, NJ –-(Ammoland.com)- New Jersey Republican Assemblyman Dancer has just filed “Shaneen’s Law” which gives Judges full discretion to avoid mandatory jail time and/or give PTI to folks like  Shaneen Allen.

Named after Shaneen Allen who has fallen victim to New Jersey insane gun laws that targets law full gun owners, with mandatory minimum sentences for things that are perfectly legal in the rest of free america.

New Jersey residents, please contact your state representatives and ask them to cosponsor this much needed legislation.

The bill is A3608.

The key language reads:

“(3) Notwithstanding the provisions of subsection c. of this section to the contrary, the court shall have discretion to impose the mandatory sentence, or pretrial intervention or supervisory treatment pursuant to N.J.S.2C:43-12 et seq., for a violation of subsections b. or c. of N.J.S.2C:39-5 if the court makes a finding on the record that the convicted person:

(a) is an out-of-State resident;
(b) is otherwise permitted by the state in which he is a resident to possess the firearm in the manner under which the conviction arose in this State;
(c) has no known association with a criminal street gang, as defined in section 1 of P.L.2007, c.341 (C.2C:33-29); and
(d) has never been convicted of a crime in this State or any other state, territory or other jurisdiction of the United States.”

This is the most insane law I have ever heard of. A lawful gun owner is given the Right To Bear Arms by the Constitution of the United States constitution , except in certain states and or Cities. How would a normal law abiding gun owner know this? The reason I know of this now is because my son and his friend drove to New Jersey on March eighth and went to purchase a truck and were stopped for a seat belt violation and he had left his gun in the car ( not knowing NJ law) as he does… Read more »

I would like to know what purpose it would serve by putting her in jail. First it is an unjust law but she is not a criminal & has 2 kids who depend on her.

i am a floridian former new yorker i have a ccw permit now for 3+ years i am law abiding but at times its best be quiet, this woman did the right thing and is being ridiculed for the rest of her life unless someone steps up and removes all this nonsense hindering her and her 2 kids. i have sister in new jersey and i think very hard about visiting her because i carry every day all day, i have contacted new jersey twice for a temporary permit but no answer yet, wishful thinking. if this country is “ever”… Read more »

so the bill gives the judge discretion on the sentence, but the person still carries the felony? which I would guess means no more CCW or clean NICS?

Hopefully there are enough decent people in NJ to help pass this bill. This woman is not the common criminal you see on everyday local new’s, she is a mother who is doing her best to raise and protect two kid’s. The attack ad’s toward the bill are going to be disgusting. I can’t prove there’s a god, but i’m praying for Shaneen.

She did the right thing by letting officer know she had concealed weapon.

Now if she exercised her right to remain silent,
and just showed her driver license and took the ticket if one was going to be issued, she would not be in this situation.

Since NJ don’t recognize her PA permit, why bother to tell LEO ‘I have concealed firearm’?

Tough situation for anyone to deal with.

Tex, I am curious who should be jailed for possession of a firearm without breaking any other laws (ie. felon in possession, etc).

This is a travesty what happened to this young woman. There are people who should be jailed over this but not her !
