USA – -(Ammoland.com)- The one thing I cannot stress enough is to learn your rights as an American citizen.

The 4th amendment is in place to protect us from this sort of tyrannical barging in of our homes and our personal lives.

This is the way to handle unruly police officers trying to gain entry into your home.

If police come to your door and you don’t need their help, you can simply decline to answer. They cannot come into your home without a search warrant. Even if the police have probable cause, they cannot come in your home without a search warrant. You might even be a suspect in a criminal investigation. In such a case you should remain silent — except to say “Officer, I can’t let you inside without a search warrant.” Following such an encounter, you should immediately contact a lawyer before speaking to police again.

The fact is that police can legally lie to try and gain access into your home and knowing how to deal with police at your door can go a long way. A video uploaded to facebook by Avel Amarel, shows Amarel doing a great job at shutting down the two officers who tried to gain access to his house.

Notice that in the beginning of the video, police try to get Amarel to stop filming. Mission number 1, reduce accountability. Cheers to Amarel for standing his ground.

Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

I am a CA APPS program highlighted ( meaning I have an angry former wife who had me placed under a Court ordered non-violent Domestic Violence Restraining Order. There is no standard of proof other than a person claims they are ‘afraid’. I have done this job, for many years in fact, but I am disabled now. I can say that in my day and at either of the departments I worked for this would never of happened or been tolerated. There was on time that I responded to a disturbing the peace call. When I pulled up on the scene I noticed an individual that I recognized from being incarcerated in the county jail. “They cannot come into your home without a search warrant” In Texas they look into the camera and say “I hear someone in distress” then barge right in and shoot everyone. So, think twice about quoting your precious constitution.

Good point on “I can not help you Officer’. When all this finally gets to the point where all respect for law enforcement erodes and they realized they are on there all alone with little or nor cooperation from the taxpayers, ” Do you job without my help” will be the norm.

Citizens have NO REQUIREMENT to help the police do their jobs, you have NO REQUIREMENT to report any crime(s) you witness, that is up to you to decide.

idadho: The way I see things, if they did that to me, and I was sentenced to jail time, my response to the judge would be: If you put me in jail, you’d better NEVER let me out! You gotta sleep sometime.

Try this in San Jose and you will get arrested for PC148, obstructing and delaying a peace officer. Then the cop and judge will conspire to find you guilty. Been there. Done that. Got 10 days jail sentence after 2 week trial.
Be aware that as you open the door, they may stick their foot in the door so you can’t close it. Once they have their foot in the door, they consider it a voluntary entry.

Something one needs to keep in mind. While law enforcement is permitted to lie to the public, civilians are not permitted to lie to law enforcement. That is actually a felony. So if you do decide to respond to a police interrogation make certain that you tell only the truth or just the answering of a question falsely, even though you are otherwise innocent of any other wrong doing, could cost you dearly.
