Tacoma, WA – Due to the passage of House Bill 1240 by the Washington Legislature and Governor Jay Inslee signing it into law on 4/25/23, Aero Precision has filed a lawsuit in conjunction with several other plaintiffs to combat this overreaching legislation, seeking a temporary and permanent injunction based on the unconstitutionality of this law.

Aero Precision LLC

The case was filed on 4/25/23 in the Eastern District of Washington, U.S. District Court. Plaintiffs include Aero Precision LLC, Amanda Banta (2012 Olympian Sport Shooter), Sharp Shooting Indoor Range & Gun Shop, The Range LLC, and the National Shooting Sports Foundation. The complaint is filed against defendants Robert W. Ferguson, Attorney General of Washington State, and John R. Batiste, Chief of the Washington State Patrol.

“We do not agree with this law and we do not think it is constitutional,” said Scott Dover, CEO of Aero Precision.

“HB1240 bans some of the most common firearms and parts available. It impacts the lawful ownership of products we manufacture and sell to thousands of our customers in the State of Washington. It also restricts the rights of the individuals, Aero Precision employees, who make these parts. We will fight this law in the courts and are confident in the outcome given the clear rulings in multiple Supreme Court cases, including Heller and Bruen.”

It’s a very well done suit; everyone should read the filing. The ban is blatantly and unarguably unconstitutional. The fact Washington politicians are undoubtably aware of this should result in extreme consequences. Passing a law (even proposing or voting for one) that is unconstitutional on its face should result in life in prison or worse. They are stripping rights away from millions with every law like this, and putting lives at risk. There must once again be consequences for politicians bad behavior.

scotus needs to review the sovereign, qualified and absolute immunity precedent that they established years ago. it was not written into the Constitution or Bill of Rights. the government is not sovereign, God is, and government needs to be held accountable or it becomes dictatorial, see present day.
also, no government agents should have any kind of immunity when they do wrong to another person, they need to be held accountable for their actions or they just repeat them over and over.
only when this happens will we have the free country our founders envisioned.

Semi Automatic Guns are “common use” … can’t ban them.
Period.
These people don’t care, tax dollars are being used, the rest of us have to write checks.
Just because some unknown person “might” engage in criminal behavior, like shooting up a school (unfortunately), doesn’t mean that my or your constitutional rights can be taken from you… This is already a proven point with the Supreme Court.
This “law” in Washington is cooked. Hopefully a injunction is issued by the more conservative eastern Washington.

Go Aero!

The complaint is filed against defendants Robert W. Ferguson, Attorney General of Washington State, and John R. Batiste, Chief of the Washington State Patrol.
One politician was left out of this law-suite —- ‘j. inslee’, who SIGNED this atrocious Anti-Constitutional “law”! THESE “politicians” MUST be held PERSONALLY RESPONSIBLE for every PENNY of the court costs, lawyer costs, work time lost, emotional distress, travel costs, hotel costs etc.. Let THESE politicians FEEL the PAIN where it hurts the most — their pocket-books, bank accounts, savings accounts and THEIR supporter support!

Firearms are forbidden in Liberaldom. In that realm, the head smasher is King! Along with cross-dressers.

I predict that there in ‘Liberaldom'(the single quotes are attempting to signify the error that the lands known as; “Liberaldom’, are anything BUT “Liberal”…). when the head smashers and crossdressers come face to face with the muzzle end of a firearm, whether made by Aero Precision or even Hi-point, they will clearly be shown to be far from smashers-in-charge, but will instead be seen to be the cowards- and losers-in-charge that they always were, but that had previously escaped the sleepy sheeple’s notice.

The legislature went full commie, not that they already weren’t, this session. There were 3 nasty unconstitutional gun laws passed, pure dimocRAT legislation, no Republican voted for any of it. There was much, much more nastiness they puked out during this session and they said they’re coming back for more, (Life’s Energy), next year during their “short session.” Unfortunately the commies have a supermajority. They also passed a law allowing people to sue gun makers, sellers. A state license to buy any gun and a 10 day waiting period even if you possess a concealed carry permit. Embolden by a… Read more »

Page 9:

“The modern detachable box magazine, which sits in the grip of the pistol, first enjoyed commercial success with the “broomhandle” Mauser in 1896.”

Whoopsie. I’m pretty sure the C96 has a 10 round internal box magazine located in front of the trigger guard.

Also:

“Grenade launchers” are very rare and already illegal as a general matter,…”

Of course grenade launchers are no more regulated than suppressors.

But still, the WA law is undeniably unconstitutional as clearly pointed out in this lawsuit.

It has been over a decade since I ‘renounced’ my WA resident status (wasn’t ever really a ‘citizen’) but IIRC there is a provision in the state constitution that enumerates the right to keep and bear arms very similar to the US Constriction. IOW this ‘law’ violates BOTH state and federal law.

You’re exactly right. I cannot understand what the legislative counsel was advising these fools, perhaps the counsel are Willamette alumni? Not only should everyone who voted for this crap, be removed, prosecuted, fined, and never ever allowed to be an elected or lobbyist.
