California Dreamin’: Newsom Wants 28th Amendment to Restrict Gun Rights

U.S.A. — Liberal Democrat California Gov. Gavin Newsom is proposing a 28th Amendment to the U.S. Constitution “to enshrine fundamental, broadly supported gun safety measures into law.”

Newsom’s office made the announcement Thursday morning, declaring in a prepared statement, “Our ability to make a more perfect union is literally written into the Constitution. So today, I’m proposing the 28th Amendment to the United States Constitution to do just that. The 28th Amendment will enshrine in the Constitution common sense gun safety measures that Democrats, Republicans, Independents, and gun owners overwhelmingly support – while leaving the 2nd Amendment unchanged and respecting America’s gun-owning tradition.”

Newsom, an ardently anti-gun-rights Democrat who has lately been waging a war of words against Florida Gov. Ron DeSantis, possibly in an effort to weaken the Sunshine State Republican’s presidential campaign, insists his proposal will leave the Second Amendment unchanged.

But is that accurate? Here’s what his proposed amendment would include, according to his website:

  • Raising the federal minimum age to purchase a firearm from 18 to 21;
  • Mandating universal background checks to prevent truly dangerous people from purchasing a gun that could be used in a crime;
  • Instituting a reasonable waiting period for all gun purchases; and
  • Barring civilian purchase of assault weapons that serve no other purpose than to kill as many people as possible in a short amount of time – weapons of war our nation’s founders never foresaw.

According to Politico, which interviewed Newsom prior to making his announcement, the Golden State governor insisted, “This is a mechanism to address that despair. We’re sick of being on the defense and throwing up our hands. We want to go on the offense and be for something and build a movement that’s bottom up, not top down.”

Politico said Newsom’s announcement came from his Campaign for Democracy PAC.

Fox News’ coverage included a refresher course on American government:

“The Constitution can be amended by either Congress or a convention of states under Article V,” the network noted. “Congress may pass a proposed amendment with a two-thirds vote in both the House and Senate, sending it to the states for ratification.”

However, Fox News threw in this caveat: “With Republicans in control of the House and a 51-49 Democratic majority in the Senate, there is virtually no chance a constitutional amendment restricting gun rights will have enough support to pass through Congress.”

The Hill is reporting Newsom’s proposal is in reaction to recent court rulings that have “rolled back” gun control laws, which it describes as “gun safety measures.” Newsom made that clear in an interview with NBC’s “Today” show.

Last year, The Hill recalled, “The Supreme Court significantly expanded gun rights last year with its ruling that struck down a New York gun law that made obtaining a permit to carry a handgun outside the home more difficult. The majority found that the Second Amendment protects an individual right to self-defense outside the home.”

According to Newsom’s announcement, “Passage of the 28th Amendment will require a convention to propose amendments to the United States Constitution, also known as an Article V Convention or amendatory convention. Working in partnership with members of the California State Senate and Assembly, California will be the first state in the nation to call for such a convention with a joint resolution being introduced by California State Senator Aisha Wahab and Assemblymember Reggie Jones-Sawyer.” Both are quoted in the news release.

“A man of action, Governor Gavin Newsom has the backbone to actually do something about the gun fetish culture around weapons of war, and tackle the relentless problem of gun violence and mass shootings,” said Sen. Wahab. “As someone impacted by gun violence, I have an obligation to elevate the voices of victims and those of us left behind in the wake of tragedy.”

“I am proud to introduce this resolution to protect the common sense gun reform legislation our Assembly Public Safety Committee has championed over the years,” said Assemblymember Jones-Sawyer. “We cannot stand idly while courts roll back our work and diminish the ability of our Legislature to keep Californians safe. This bold but fair resolution calls on other states to join us in protecting some of the most effective ways of reducing gun violence.”

Nowhere in Newsom’s announcement or in coverage of his proposed constitutional amendment is there a single reference to holding criminals accountable for violent crime.

He’s having his usual temper tantrum because he lost Miller v. Bonta the other day, which was his attempt to stop the state from being sued over their asinine gun laws. I predict he has more losses on the way.

Thank You!!!! How anyone supporting a “Convention of States” doesn’t believe there will be those like Newsome waiting in the wings is beyond me.

KenW

Yes, there would be, but amending the constitution is, and should be the proper way to address some issues, not by legislative, executive order, or judicial fiat.
When these blowhards squawk about how we need to repeal the Second Amendment, most do not care about amending the Constitution to get it done. It isn’t just 2A that the Progressives are against, the entire “Bill of Rights” is

Boz

We need to bring back tarring and feathering.

I’d go for a public hanging where Newsom is concerned.

To put the United States on a more rational footing, I propose a constitutional amendment that declares pi to equal 22/7, because, well, irrational numbers are just not very rational.

Makes about as much sense as Gav’s proposal, don’t it?

He’s doing nothing more than bloviating political hyperbole. Considering he wants to run for President. There is 0 change of getting such an Amendment passed. The last time an attempt to add a Constitutional Amendment was the ERA Equal Rights Amendment. Which was originally proposed in 1923, It wasn’t ratified by Congress until 1972. It failed ratification from the states and was dead ended after 10 years..The 15 states that did not ratify the Equal Rights Amendment before the 1982 deadline were Alabama, Arizona, Arkansas, Florida, Georgia, Illinois, Louisiana, Mississippi, Missouri, Nevada, North Carolina, Oklahoma, South Carolina, Utah, and Virginia.

Let me tie half my brain behind my back to make this fair. Liberalism is a mental disorder. DSM-5 & pop-psych cultural attitudes & mores needs to be gutted. Too many people on Meds & other’s living in a Disney
Animated matrix surreal state of mind in an altered state of conscious reality.

USMC0351Grunt

Society was doing that back in the 60’s and 70’s when “they” dumped psychotropic and hallucinogenic drugs on the younger people in their attempt to win the hearts and minds. The term, “mother’s little helper” was all too common as was Valley Of The Dolls”.

Tank

Yes. That whole epoch era has taken it’s toll & the generations of progeny they created are following with lobotomized medical zombies hooked on benzodiazepines, anti-depressants, SSRI/SSNRI’s in altered states of consciousness trying to cope with what we call life. Social engineering’s Frankenstein.

How many people are killed by ‘assault weapons’ every year? Near as i can tell using FBI statistics it is somewhere between 18 and 75… Out of around 11,000 actual firearm homicides per year. So his proposal is to get his toe in the door, they want all guns and next will be handguns which statistically make up over 90% of murders… They know that 75+% of firearms owned by americans are handguns, and they won’t care at the point they have a law like this in place. They will leave the law open ended to pass whatever amendment to… Read more »

So we can’t have an intelligent conversation on here without being accosted by you apparently… You are used to low brow communication that requires adherence to dogmatism that shuts down any real or effective understanding of the enemy. It’s an old, old counter Intel strategy that i think you aren’t even aware of, you’re just parroting bullsht you heard someone else say 10 years ago and don’t have any real clear idea of what you’re even talking about…that, and i’m guessing you’re drunk from about 10am on everyday judging from your posts…

Chuck

Semantics (Some Antics). Everyone with even an ounce of common sense knows its pointless to blame an inanimate object of a crime.

USMC0351Grunt

Yet it is ALWAYS the inanimate object, (The gun) that always gets blamed and in well over 45 years of this rhetoric not ONE firearm has ever been prosecuted. Much like the “War On” syndrome whereas Drugs, Terror, etc. can never be prosecuted yet society eats up the possibility of actually winning these faux wars like they are the next best reality TV show.

We can’t.
Most of the people on here have no idea how to organize anything let alone follow through.
Most have never served under any form of command.
We all understand how frustrating this government is. We agree on that.

Most don’t even know how to use a 2 way radio.
No chance of organizing anything when the left controls the media and all social media.

The F-FBI will shut you down before you get off your porch.

Better organizing a more modern strategy is going to be required to bring down this tyrannical government.

how many people are killed by bad laws …or rules government agencies make themselves

I agree with you totally. He and the others need their lights turned off. They all (DEMORATS) are full of crap. They need to uphold the constitution like they took the oath when taking office which they will never do till WE THE PEOPLE take action to get rid of the tyranny in the WH and everywhere else. I’m tired of this BS.

DREAM? Don’t you mean NIGHTMARE??? nasty nancey’ nephew ‘newsom’ IS a LIVING NIGHTMARE!!! LOOK what they have done to a ONCE BEAUTIFUL California/Commyfornication!!

He’s just trying to appeal to the globalist group to prove he’s worthy to be appointed to the U.S. presidency.

Hey, hey, look at me! I can be just as crazy as you want me to be.

It won’t go anywhere and he’ll discover that the U.S. won’t tolerate that stupidity.

Zhukov

How about we pass an amendment to remove the citizenship of idiots like newsome who want to take our constitutional rights.

Laddyboy

Nasty nancy pelosi’s nephew can take a long walk off a short pier over a tank of hungry sharks. THAT would be a good use of the LIER bag of bones!

JNew

Why do people always miss the point?!

Of course, this itself won’t gain enough speed to happen — and Newsom and the DNC know it. The goal is to open up a nationwide dialogue about it. After five or so years of pushing for *some* kind of ban, there will be a political need to “negotiate” so Republicans won’t look unreasonable. Whatever transpires, it’ll be a step away from your liberty, and the progressive left will win again.

If you want to beat the anti-American left, you gotta think like them first.

KK

Newsom is a fool.
Does he think Americans would comply and surrender their rifles?
Democrats should concentrate on passing laws that would actually have an effect on PROTECTING US Citizens . . . like making it illegal for forest fire smoke to cross our National Borders!

Yes and no, because any amendment would still require 3/4 or 38 States to ratify.

Chuck

The only way I’d support a CC, is if it’s declared up front that No Amending of the original Bill of Rights (The first 10 Amendments) will be tolerated or discussed. That the original 10 are Sacrosanct, and therefore Untouchable.

USMC0351Grunt

I do believe that is why Neuman wants to add an amendment outside of the 2nd amendment to control possession, sales, etc. of firearms.

Chuck

Keep Smoking the Wacky Tobaccy Gruesome. You need 38 States or States’ Legislatures to Ratify any proposed Amendment, and you’re nowhere near having even half of the 50 on board with Infringing on the 2nd.

FOAD ARSEHOLE!

gregs

anyone can propose a Constitutional Amendment. i propose that leftists/progressives cannot be elected to any position in federal, state or local government until the end of time, rino’s are bad enough.
that might have a better chance of passing than this idiots amendment.

Laddyboy

Incorrect! A Constitutional Convention of States —- IS a VERY LIMITING process and requires a MAJORITY of States accepting the PROPOSED changes. NOT ONE State or Group can manipulate the process. You need to read up on the COS before you make INAPPROPRIATE and ERRONEOUS statements. I see a lot of people have not READ UP or even LOOKED at the COS process.

Shotsmith

CORRECT

KK

The Second Amendment is NOT “A right to a gun that a totalitarian is comfortable ALLOWING us”. The Second Amendment is a RIGHT to a CAPABILITY. IT IS A BALANCE OF POWER! Outlawing semi-automatic AR15 type rifles and standard full capacity magazines is NOT a “reasonable compromise” – IT IS THE ENDGAME! It is the difference between an effectively armed citizenry that possesses the capability to defend it’s freedoms – and a citizenry restricted by law to low capacity sporting arms that NO LONGER possesses the capability to defend it’s freedoms! It would shift THE BALANCE OF POWER firmly to… Read more »
