A New York State law that will require background checks for ammunition purchases will go into effect on September 13, 2023, and it is going to cost you money and privacy.
The New York State Police Department will handle this new background check system. Not only will the State Police be handling the background checks for ammunition, but they will also now be handling all background checks for New York firearm purchases. Background checks typically go through the Federal Government, where a gun registry is illegal. New York State has now taken over the background check system for all NY gun purchases, bypassing the Federal Government and sending private and personal information directly to the New York State Police Department.
To fund this new program, the State of New York will be requiring firearm purchasers to pay $9 for their own firearm background check and $2.50 for each ammunition background check. Besides the burden of additional costs for the privilege of being infringed upon, FFLs and gun owners have other concerns with this new legislation. Some of those include the possibility of purchase delays, poor handling of critical data, and the concern that New York State will be building a database of gun owners to be used for future confiscations or harassment.
The plaintiffs in the Gazzola v. Hochul lawsuit filed an Emergency Motion on August 29, 2023, to the Second Circuit Court of Appeals in Manhattan, seeking an immediate injunction to stop the Governor and the NYS Police from their intended take-over of the firearms background check system, the launch of the ammunition background check system, and the investigation of federally-licensed dealers in firearms through the NYSP “Joint Terrorism Task Force.”
According to Attorney Paloma A. Capanna, “Governor Hochul has made clear that she will use a state background check system to create a gun owners’ registry – the first of its kind in the history of this nation. Acting Superintendent Nigrelli made clear he will have “zero tolerance” for anyone violating the new laws, and that means dealers with retail space in New York face imminent arrest since the investigations started on July 25, 2023.”
We saw Kathy Hochul defy the Constitutional rights of New York State Residents when she implemented the CCIA immediately after the Bruen decision.
Why would she not defy New York State residents’ rights to privacy by creating a gun registry through this new New York State-controlled background check process?
Matt Mallory is the owner of PS&Ed (Public Safety and Education), a Type 07 Class 02/SOT FFL/Gun Store in Upstate NY. According to Matt, during the process of registering his FFL for the new State background check system, he received a message from the NY State Trooper NICS department and was asked to call them back and speak with “agent 320”. The agent would not provide his name to Matt when asked.
Mr. Mallory said, “This appears to be a way for the State and their employees to stay anonymous while dealing with legal and fully compliant NY State Gun Stores! It must be nice that they can hide behind a number when FFLs are exposed to anyone that wants to target or sue us for dealing in legal products.”
The New York State Extreme Risk, Protection, Order, a.k.a. Red Flag Law, allows for the confiscation of guns without due process. Many people are concerned that this new background check scheme, with the potential to double as a gun registry, is designed to work in conjunction with New York State’s Red Flag Law because before you can confiscate guns, you need to know where they are located.
Attorney Paloma Capanna said, “Calling all federal firearms licensees in New York to go on strike on Wednesday, September 13, 2023 by closing their front doors and refusing to transmit gun owner information to the Governor and the State Police. We’re asking Citizens to stand in solidarity with their local FFLs by firing a single shot at their local rod & gun clubs and ranges to create a “Shot Heard ‘Round the State” on that same day, at high noon. This “Strike & Shoot” is unprecedented in the history of our country. This is our Boston Tea Party.”

The 2nd Amendment is not a privilege. It’s your right.

We have the NH State Police do the handgun background checks here. They try to change the rules to deny transfers every chance they get and then you have to appeal your case to the FBI to get it fixed. I imagine New York will be ten times worse.

gave you a thumbs up. It’s easy to talk about the tyranny you deserve when you move to a state that is constitutional carry or were born in one.
I tried to get him to change it to people that don’t vote and gave explinations that many states are dictated rules by the majority and that majority is the big leftists cities that outnumber the remainder of the state like in Oregoneistan but it didn’t sink in.

Except I didn’t move to a Constitutional Carry state. 30 plus years ago when I moved. It was a ‘May Issue’ based on whether the local sheriff wanted you to have a permit. Which in most cases meant NO. In the county I moved to there were less than 20 permits issued in 1990.
I moved into a ‘may issue’ state. Where a concealed carry license and a required permit to purchase under the same guidelines existed. Getting a permit to carry was near impossible, depending on the sheriff in your county’s inclination to give you one. I immediately became politically active to change the laws, I supported candidates and worked inside the campaigns that believed in the 2nd amendment and law abiding citizens Right to Keep and Bear Arms. yesterday he made a comment on New Mexico to someone who stated that the protesters would riot. I stated looks like the Mexicans (as referred to by the governor) are getting the tyrants actions that they voted for and deserve hoping it would send the point home and maybe he would see to change it. You can apply your last sentence to O’biden and his ATF too. I read that he wants to stop people from being able to build their own ammo too. They stated that it might go as far as having to turn powder, primers and projectiles in and that people would be allowed a maximum of 100 bullets for the legal guns he allows. We all know he calls anything semi auto an assault weapon. Canada, the testing grounds for America, is undergoing the same problem today.

I just looked at the judge’s opinion and she chooses to ignore “under this chapter” in favor of saying § 926 only applies to the U.S. Attorney General. I’m no legal scholar but that interpretation is contrary to other sections of Chapter 44.
It’s just a way to jack up the price and build in whatever delay they decide is necessary.

Here in Florida, the FDLE runs the background check system since 1991.
Ammo buys in Florida do not currently require background checks, and there is no federal requirement either. But I remember long ago my drivers license number being recorded when I bought ammo from Wall Mart. Havnt bought ammo or armd locally for decades. My last internet ammo buy the seller wanted a pic of my drivers license.
Walmart checked my drivers license too, during the “shortage” or “pandemic”.

Relying upon an unjust and 100% corrupted legal system for our justice, is the greatest folly that anyone could EVER undertake! Why is this so hard for people to see?
