NRA Files Amicus Brief with Ninth Circuit in Challenge to California’s One-Gun-Per-Month Restriction

NRA filed an amicus brief with the Ninth Circuit Court of Appeals in Nguyen v. Bonta.

Nguyen is a challenge to California’s law prohibiting the purchase of more than one firearm within any 30-day period.

The case of Nguyen v. Bonta centers around a contentious law introduced by the state of California that limits the purchase of handguns to just one per month. This restriction was challenged in December 2020 by several gun rights advocates, including the plaintiff, Nguyen, who argued that the regulation infringes upon their Second Amendment rights.

California’s stance has been to defend the law as a measure to prevent gun trafficking and reduce gun violence. They argue that limiting the number of handgun purchases makes it more difficult for individuals to buy guns in bulk for resale to criminals or other illicit purposes….

In March of this year, the U.S. District Court for the Southern District of California held California’s one-gun-per-month restriction unconstitutional. The State then appealed that decision to the Ninth Circuit Court of Appeals.

NRA filed an amicus brief with the Ninth Circuit in support of the plaintiffs and affirmance of the district court’s ruling.

The brief argues that California’s law violates the Second Amendment because the right to keep and bear arms includes the right to acquire firearms, multiple gun purchases per month were common in early America, and there were no historical limitations on the number of firearms that law-abiding citizens could purchase.

You know what!!! I left that dump because of bullshit like this. Just before I left they installed the special mag release, no pistol grip on your AR no hand grip on the front of it and no 30 round magazines. I didn’t even own an AR but I wanted some pistols and their bullshit list didn’t have what I wanted because everything was already 10 rounds and they had a 10 business day waiting period. I tried to get a carry permit in Sacramento and they would not give me one at 22yrs old, 25, yrs old 30 yrs… Read more »
