Standing Against ATF Overreach: PSA & GOA File Amicus Brief in U.S. vs. Wendt ~ VIDEO

On October 18, 2024, Palmetto State Armory, alongside FRAC (Firearms Regulatory Accountability Coalition), Gun Owners of America, B&T USA, and eight states, filed an amicus brief with the U.S. Court of Appeals for the Eighth Circuit. This filing opposes the ATF’s controversial unauthorized expansion of the 1986 machine gun ban, known as the Hughes Amendment, which was leveraged against former Iowa Police Chief Bradley Wendt. This case marks a critical battle over gun rights and government overreach.

The Hughes Amendment, part of the Firearm Owners Protection Act (FOPA), restricts the civilian ownership of machine guns manufactured after May 19, 1986. The law aimed to curb access to machine guns for the general public, but its enforcement has been increasingly scrutinized for overstepping its original scope. In United States vs. Wendt, the ATF prosecuted Wendt, who had taken a machine gun registered to his police department to a public range event. Wendt, formerly the Police Chief of Adair, Iowa, was sentenced to federal prison in July 2024 for this conduct.

ATF Overreach

The ATF argued that Wendt’s actions were outside his “official duties” as a police officer, a phrase absent from the Hughes Amendment’s legal text. Critics argue that the ATF’s insistence on this interpretation represents an alarming trend in the agency’s efforts to broaden the scope of laws beyond what Congress intended.

The prosecution highlights the ATF’s disturbing tactic of prosecuting individual gun owners in an attempt to influence broader gun regulations.

Palmetto State Armory and its allies, including Gun Owners of America, are pushing back. By filing this amicus brief, they assert that the ATF is using the court system to achieve regulatory goals that failed through legislative or regulatory channels. These groups contend that prosecuting Wendt for what would normally be considered lawful conduct is an abuse of power designed to create new legal precedents that could undermine Second Amendment rights.

This isn’t the first time the ATF has been accused of overstepping. Throughout the years, the judiciary has served as a bulwark against these attempts, preventing the agency from expanding its powers through the courts. However, cases like United States vs. Wendt reveal a shift in tactics—targeting vulnerable defendants, such as local law enforcement officers, who lack the resources to fight back against the full weight of the federal government.

Palmetto State Armory, a staunch advocate for gun rights, opposes the Hughes Amendment and all attempts to expand it. The company, through its partnership with groups like Firearms Regulatory Accountability Coalition (FRAC) and Gun Owners of America, is committed to defending Americans’ constitutional rights and standing firm against government overreach. This fight is not just about a single case—it’s about preserving freedoms for all gun owners.

By supporting companies like Palmetto State Armory, you’re not just buying a product—you’re supporting the defense of your rights. Every purchase helps fund legal battles like this, ensuring that the Second Amendment remains protected from overreaching government agencies. Together, we can ensure that freedom continues to thrive in America.

Rogue Agencies

As the ATF continues to seek ways to expand its regulatory powers, it’s critical that Americans stay informed and engaged in the fight for their constitutional rights. The U.S. vs. Wendt case represents a significant legal battle, one that could set the tone for future government attempts to control firearms. With allies like Palmetto State Armory leading the charge, there’s hope that justice will prevail and freedom will endure.

It really is astounding how few gun companies are actually pro gun. It’s nice to see PSA and B&T stepping up, and not just with a donation to a 2A group, but getting involved legally. It’d be nice if the NRA got involved, since they supported the Hughes Amendment to help correct the mess they helped create… But I guess they’re too busy Negotiating Rights Away. And all this really does beg the question, where has the Republican Party been? The so called defenders of the constitution and the America we all used to know? Where are they? (It’s a… Read more »

Bottom line. The government wants control of all firearms and those that hold them. Remember when O’bummer wanted a national police force? Did you know that ObiDUMB ok’d the blue hats to come into our country to help control us? Did you know that the blue hats from China have been training in Canada? Have you seen the multiple of Chinese young fighting age… Read more »
