Hialeah, FL – In the early hours of Saturday morning, a mobile mechanic fatally shot a man wielding a machete in what police have determined to be a justified act of self-defense.
The incident occurred around 1:30 a.m. near W 2nd Avenue and 29th Street. According to Hialeah Police, the confrontation began when 36-year-old Michel Lope Montes de Oca called for a mobile tire repair service. When mechanic Brandon Hurst, 29, arrived and replaced the tire, Montes de Oca became agitated upon discovering that the replacement tire was used.
Tensions escalated as Montes de Oca reportedly began verbally threatening Hurst. The situation took a deadly turn when Montes de Oca armed himself with a machete and charged at the mechanic.
Fearing for his life, Hurst drew his concealed firearm and shot Montes de Oca, who was pronounced dead at the scene. After a thorough investigation, Hialeah Police concluded that the shooting was justified as self-defense.
Authorities took Hurst into custody but have not filed charges pending further investigation.
Once again, self-defense rights, save the day, particularly for those who carry legally to protect themselves from imminent threats. Police continue to investigate, and more details are expected to emerge.
For residents, this tragic event underscores the unpredictable dangers that can arise in everyday situations and the critical role self-defense can play in personal safety.
To the uninformed one can be taken into police custody and not be arrested. Its not uncommon or unusual for someone to be taken into custody and not be arrested while a field investigation is performed. Cops have to sort out what happened and interview witnesses etc. The mechanic is lucky this defensive action was in Florida and not a blue state and city where a homocide would mean certain arrest and confiscation of his arm. I also was held in police custody after I was attacked by a hyped up asshole and I drew my weapon on him. Police… Read more »
Contradictions in the reporting: “Police say this was an act of self-defense and that the killing was justified” AND that the dead guy is the victim.
Hialeah is arguably the worst city in Florida in which to live. The mechanic was ready to defend himself because it’s necessary in Hialeah.
Overwhelmingly, the tendrils and tar of the state are binding the citizen to the point of an unending bureaucratic morass that erases any rational notion of freedom. In an ordered and sensible society, the defender is rightfully celebrated, and there’s nothing to be lost by standing for the truth. In this mess, “shoot and leave” or burying perps in the back 40 becomes the only way to preserve your freedom from the legal spider web of the state and attendant financial ruin. A brave marine protects a subway car full of innocents from a violent wack job with a mile-long… Read more »
This doesn’t make sense. If it’s “justified” why’d he get taken into custody? Wouldn’t that mean they arrested him? And if it’s not justified, why isn’t he charged with murder?
Further, the end of the article says “once again self defense rights save the day”. I don’t know, did they? Either there’s some MAJOR details missing from this piece or that poor mechanic’s about to face an even bigger threat than that thug on the side of the road… A tyrannical Uncle Sam.
