N.J., and U.S. Gun Ban Groups, Pile on in Mag Ban Case

New Jersey – -(Ammoland.com)- July 11, 2018. ANJRPC’s federal lawsuit to overturn Governor Murphy’s firearms magazine ban is starting to pick up speed. There has been a flurry of activity since the court scheduled an expedited hearing on Association of New Jersey Rifle and Pistol Clubs’s request for an injunction (to halt enforcement of the ban until the case is decided).

The State of New Jersey was first to oppose the injunction motion, arguing among other things that the newly banned magazines are “dangerous and unusual weapons” not protected by the Second Amendment, which pose a danger to the public even in the hands of law-abiding citizens. The State also argues that the banned magazines are not needed for self-defense, but are “perfectly suited for illicit use.”

“Claiming that banned magazines are not needed for self-defense while simultaneously exempting their use for the protection of lawmakers is outrageous and the height of hypocrisy,” said ANJRPC Executive Director Scott Bach. “This elitist double standard is irrational, indefensible, and shows the utter contempt New Jersey has for its ‘subjects,’” said Bach.

Piling onto the State’s papers, the Giffords Law Center and Everytown For Gun Safety filed their own opposition to the injunction motion, arguing among other things that standard capacity magazines are best suited for military use, that NJ’s prior regulation of magazine capacity for several decades makes the new ban presumptively valid, and that the ban will make mass shooting incidents “less lethal.”

On July 9, Association of New Jersey Rifle and Pistol Clubs ripped all of these arguments to shreds in a reply brief filed in the case.

This case was filed in cooperation with the National Rifle Association. “We thank the NRA for its incredible support and guidance, which made this aggressive lawsuit challenging the magazine ban possible,” said Bach.

I have a long-time friend who owns a gun dealership in the state where I reside. He moved to the armpit state two years ago-more $$$ than he could pass up, so don’t go making disparaging remarks. He sends me news articles occasionally that he finds relevant to me and him as 2A supporters. Something that has stood out to me while reading them is that the legislators and leaders from the bottom up is how they invariably refer to their constituents as “subjects”. Can someone please explain why it is that most gun rights groups skim over the OBVIOUS wording in 2A which makes it clear as glass that qualified, trained citizens should be allowed the same armament (arms) as the (possibly in the future tyrannical) government? This was the primary original intent and is as clear to most of us now as it was to the founders when they put pen to ink. These are just the state’s that allow a recall. Each state has a mechanism for removing corrupt officials by way of Grand Jury Investigation, Indictment and Prosecution but it ALL starts with the citizens with backbone stepping up to the plate and moving forward with a Notice and Demand against the corrupt heathens and then moving forward with a charge of Willful Neglected of Statutory Duty through grand jury indictment. Many may not realize it but this is an extremely high crime!

The Second Amendment expresses the founders intention to fill the legal field regarding arms. dummies forget that SCOTUS just recently declared in a case they decided that weapons of military use ARE precisely what “arms” means in that pesku Second, and thus the AR and similar cannot be banned as they ARE weapons of military use. A Magazine is not a weapon as it says in the article. A magazine is only a piece of the whole. As a piece of equipment, a magazine cannot be a weapon by itself. It is like a container full of sugar cubes. Or a 24 pack of pepsi. A magazine only is the holder of something.

@john- just fir kicks I loaded up one of my 20 round AR10 mags and beat a fiberglass shower enclosure to death with it. It proved to be quite dangerous to that enclosure, but a hammer or baseball bat would have been a better choice. And as you can orobably guess, not one round went off during the entire time.
