Take Action – Urge Congress to Overturn ATF’s Brace Rule

The U.S. House is expected to hold a vote next week on H.J.Res.44, legislation that would overturn the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) pistol brace rule. H.J.Res.44, sponsored by Rep. Andrew Clyde (R-GA) and Rep. Richard Hudson (R-NC), is a disapproval resolution under the Congressional Review Act (CRA) that would invalidate ATF’s brace rule and block the agency from reissuing the same rule in the future. The U.S. Senate may consider companion legislation sponsored by Senator John Kennedy (R-LA) shortly thereafter. Please contact your federal legislators today and encourage them to vote “YES” on the disapproval resolution.

ATF’s unlawful rule on stabilizing braces would subject virtually all firearms with attached stabilizing braces to the registration requirements of the National Firearms Act (NFA) – the deadline to register these previously-acquired firearms was Wednesday, May 31, 2023.

Beginning in 2012, when President Biden was serving as then-President Barack Obama’s vice president, the ATF had recognized that stabilizing braces serve a legitimate function, and the inclusion of a stabilizing brace on a pistol or other firearm does not automatically subject that firearm to the provisions of the NFA.

But now, President Biden’s ATF has reversed over a decade of agency guidance and rulings that the firearms industry and law-abiding American gun owners have relied on when designing or acquiring firearms. Stabilizing braces were designed to enable gun owners to operate certain firearms with one hand with more stability. The ATF’s new rule says, essentially, that using a stabilizing brace with a pistol turns the firearm into a short-barreled rifle and must now be regulated by the NFA — and now the millions of Americans who own a pistol and a stabilizing brace, regardless of style, caliber, or type of brace, must either dispose of, alter, or register their firearms. If they don’t comply, they will become felons and face ten years in prison and large fines.

If you’re going to urge you legislators to overturn something, make it the NFA. Overturn that, and there won’t be any basis for a brace ban…or even a stock ban.

Note the picture of Jim Grant in the top of this article. The “brace” is used against the shoulder as a “stock.” He has a SBR!

As much as I hate the ATF and this stupid rule, you make a point here. The whole reason this regulation ever came out is because of people doing exactly what Jim Grant is doing…posting pictures and videos of themselves using the brace as a stock. The brace was approved for persons with disabilities to use in order to fire their AR pistol as a pistol. But every fool with a YouTube channel had to post a video of them using it as a stock. One of my issues too. There’s a dummy named Clint and his chunky wife over at Classic Firearms that has spent years doing the same thing on their cheesy videos. I called them on the phone once about 3 years ago pointing out the errors of their way only to be hung up on. Dummies each and everyone of them, who’s stupid enough to have themselves photographed misusing a tool.

AFT repeatedly stated that braces were legal and that shouldering one does not make an SBR. It was a simple, technical workaround for something which is only illegal through a technicality. Barrel length restrictions in the NFA are an arbitrary restriction with no reason or benefit – just a technicality. Do you object to people taking advantage of tax loopholes as well?

I agree that most braced pistols are pseudo-SBRs – but the correct solution is removing nonsensical barrel restrictions from the NFA. That’s common sense gun control reform I can support.

This issue may eventually end before SCOTUS, but that takes time. The 2A warriors are cranking out the lawsuits to speed that along. The reality is that this act will likely not make it through the senate. We all know that Clownshow Joe will not sign it if it does. If it doesn’t pass the senate, Manchin(WV), Tester(MT) and Sinema(Az), who are up for reelection in 24, will have some ‘splainin to do back home in their pro gun states. Didn’t you get the memo that the USSC/SCOTUS reversed Roe v. Wade last year? That is completely false. The bump-stock ban final rule stated that bump-stock-type devices were now classified as machine guns. Bans on semi-automatic rifles were never part of the bump-stock ban regardless of whether they could or could not accept a bump-stock-type device. Stop making shit up.

Ben Franklin said that. As to any divisions being created between various gun owners and any arguments being fomented, I don’t see it. However, we all can see the criminality of the ATFE, but hardly anyone but me can see the solution to it all! It is to expose the crimes being committed by the legal system, because then ALL of its pretense of power and authority over us just fades away! Since when do criminals get to dictate any terms to anyone else?
